“DeliveryLo” is a trademark of “Clickship Delivery Private Ltd”.DeliveryLo was founded in February in 2022. This application is registered with the name "Clickship Delivery Private Limited". DeliveryLo app is a service provider app which provides delivery of products in a few minutes. The delivery includes delivery of cosmetics, confectionery, grocery, food, stationary products etc in a few minutes. Another important feature offered by DeliveryLo is the Pick n Drop feature where you can get your product picked and get it dropped at a respective location. We deliver the products promptly at home.

Acceptance Of Terms

Thank you for using DeliveryLo. These Terms of Use (the "Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the DeliveryLo Application at Play store & App store. These Terms are effective for all existing and future DeliveryLo customers. By accessing this site (hereinafter the “Marketplace”), you agree to be bound by the same and acknowledge that it constitutes an agreement between you and the Company (hereinafter the “User Agreement”). You may not use the Services if you do not accept the Terms or are unable to be bound by the Terms. Your use of the DeliveryLo Platform is at your own risk, including the risk that you might be exposed to content that is objectionable, or otherwise inappropriate.

The terms ‘visitor(s)’, ‘user(s)’, ‘you’ hereunder refer to the person visiting, accessing, browsing through and/or using the Marketplace at any point in time.Should you have need clarifications regarding the Terms of Use, please do write to us at at info@deliverylo.com

Services Overview

The Marketplace is a platform for domestic consumers to transact with third party sellers, who have been granted access to the Marketplace to display and offer products for sale through the Marketplace. For abundant clarity, the Company does not provide any services to users other than providing the Marketplace as a platform to transact at their own cost and risk, and other services as may be specifically notified in writing.

The Company is not and cannot be a party to any transaction between you and the third party sellers, or have any control, involvement or influence over the products purchased by you from such third party sellers or the prices of such products charged by such third-party sellers. The Company therefore disclaims all warranties and liabilities associated with any products offered on the Marketplace.

Services on the Marketplace are available to only select geographies in India, and are subject to restrictions based on business hours and days of third party sellers.

Transactions through the Marketplace may be subject to a delivery charge where the minimum order value is not met. You will be informed of such delivery charges at the stage of check-out for a transaction through the Marketplace.

Transactions through the Marketplace may be subject to a convenience & safety fee. You will be informed of such convenience & safety fees at the stage of check-out for a transaction through the Marketplace.

Eligibility

However, if you are a minor, i.e. under the age of 18 years, you may use/access the Marketplace under the supervision of an adult parent or legal guardian who agrees to be bound by these Terms of Use. You are however prohibited (even under provision) from purchasing any product(s) which is for adult consumption, the sale of which to minors is prohibited.

The Company, in its sole discretion and without liability, reserves the right to terminate or refuse your registration, or refuse to permit use/access to the Marketplace, if: (i) it is discovered or brought to notice that you do not conform to the eligibility criteria, or (ii) the Company has reason to believe (including through evaluating usage patterns) that the eligibility criteria is not met/is violated by a user, or (iii) may breach the terms of this User Agreement.

Account & Registration Obligations

All users must register and log in for placing orders on the Marketplace. You must keep your account and registration details current and correct for all communications related to your purchases from the Marketplace. By agreeing to the Terms of Use, you agree to receive promotional or transactional communication and newsletters from the Company and its partners. You can opt out from such communication and/or newsletters either by contacting the customer services team of Marketplace or by placing a request for the same.

Pricing

The Company aims to ensure that prices of all products offered for sale are true and correct. However, from time to time, the prices of certain products may not be current or may be inaccurate on account of technical issues, typographical errors or incorrect product information provided to the Company by third-party sellers. In each such case, notwithstanding anything to the contrary, the Company reserves the right to cancel the order without any further liability.

Subject to the foregoing, the price mentioned at the time of ordering a product shall be the price charged at the time of delivery, provided that no product offered for sale on the Marketplace will be sold at a price higher than its MRP (maximum retail price).

Advertising

• Some of the Services are supported by advertising revenue and may display advertisements and promotions. These advertisements may be targeted to the content of information stored on the Services, queries made through the Services or other information. 

Disclaimers

• You acknowledge and undertake that you are accessing the services on the Application and transacting at your own risk and are using your best and prudent judgement before entering into any transactions. The Company makes best efforts to display available products, including in respect of their colour, size, shape and appearance, as accurately as possible. However, the actual colour, size, shape and appearance may have variations from the depiction on your mobile/computer screen.

• The Company does not make any representation or warranties in respect of the products available on the Marketplace nor does the Company implicitly or explicitly support or endorse the sale or purchase of any products on the Marketplace. The Company accepts no liability for any error, inaccuracy or omission of third parties or for information/inputs received from third parties and provided to you through the Marketplace or otherwise.

• You acknowledge and agree that the Company shall not, at any time, have any right, title or interest to any product(s), which is subject to a bipartite sale and purchase contract between you and the relevant third party seller. The Company does not have any control over the quality, failure to provide or any other aspect whatsoever of the product(s) and is not responsible for damages or delays on account of products which are out of stock, unavailable or back ordered.

Reviews, Feedback, Submissions

• All reviews, comments, feedback, suggestions, ideas, and other submissions disclosed, submitted or offered on the Marketplace or otherwise disclosed, submitted or offered in connection with use of the Marketplace (collectively, the Comments) shall be and remain the property of the Company. The Company will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from any Comments, and publish, display and distribute any Comments submitted for any purpose whatsoever without restriction and without compensating the user in any way.

Copyright & Trademark

• The Company, its suppliers and licensors expressly reserve all intellectual property rights in all text, programs, products, processes, technology, images, content and other materials which appear on the Marketplace. Access to or use of the Marketplace does not confer and should not be considered as conferring upon anyone any licence, sub-license to the Company’s intellectual property rights. All rights, including copyright, in and to the Marketplace are owned by or licensed to the Company. Any use of the Marketplace or its contents, including copying or storing it or them in whole or part is prohibited without the express prior written consent of the Company

• You may not modify, distribute or re-post anything on the Marketplace for any purpose. The names and logos and all related product and service names, design marks and slogans are the trademarks/service marks of the Company, its affiliates, its partners or its suppliers/service providers. All other marks are the property of their respective owners. No trademark or service mark licence is granted in connection with the materials contained on the Marketplace. Access to or use of the Marketplace does not authorise anyone to use any name, logo or mark in any manner. References on the Marketplace to any names, marks, products or services of third parties or hypertext links to third party sites or information are provided solely as a convenience to you after having express consent from third parties and do not in any way constitute or imply the Company’s endorsement, sponsorship or recommendation of the third party, the information, its product or services

• The Company is not responsible for the content of any third-party sites and does not make any representations regarding the content or accuracy of material on such sites. If you decide to access a link of any third-party websites, you do so entirely at your own risk and expense.

 

Objectionable material

You understand that by using the Marketplace or any services provided on the Marketplace, you may encounter content that may be deemed by some to be offensive, indecent, or objectionable, which content may or may not be identified as such. You agree to use the Marketplace and any service at your sole risk and that to the fullest extent permitted under applicable law, the Company and its affiliates shall have no liability to you for any content that may be deemed offensive, indecent, or objectionable to you.

Termination

• This User Agreement is effective unless and until terminated, either by you or by the Company. You may terminate this User Agreement at any time, provided that you discontinue any further use of the Marketplace. The Company may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Marketplace.

• The Company’s right to any comments and to be indemnified pursuant to the terms hereof, shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for product(s) already ordered from the Marketplace or affect any liability that may have arisen under the User Agreement prior to the date of termination.

Governing & Jurisdiction

• The User Agreement shall be governed by and construed in accordance with the laws of India, without giving effect to the principles of conflict of laws thereunder.

• Any dispute or difference, whether on the interpretation or otherwise, in respect of any terms hereof shall be referred to an independent arbitrator to be appointed by the Company. Such an arbitrator’s decision shall be final and binding on the parties. The arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996, as amended or replaced from time to time. The seat of arbitration shall be Delhi and the language of the arbitration shall be English.

• Subject to the aforesaid, the Courts at Delhi shall have exclusive jurisdiction over any proceedings arising in respect of the User Agreement.

Grievance Redressal Mechanism

In accordance with Information Technology Act, 2000 and the Information Technology (Intermediaries Guidelines) Rules, 2011 and the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020 the name and contact details of the Grievance Officer and Nodal Person who can be contacted for any complaints or concerns pertaining to the Marketplace, including those pertaining to breach of the Terms of Use or any other policies are published as under:

We - Clickship Delivery Private Limited, are committed to protecting the privacy and security of your personal information as privacy is important to us and ensuring the trust is maintained.

This policy applies to all information gathered from our App.

Information We Collect

We collect personal information only from our app. Such information is collected for the sole purpose of understanding and improving our users' experience on our application.

Value Your Privacy

At DeliveryLo, we take privacy seriously, and treat your data as if it is our own. We ensure to keep your data safe, and do our best to limit our collection to the minimum required to offer the services all our customers expect. 

Personal Identification Information

Some visitors to our app may choose to sign up for the Services we provide, and/or may make purchases from us. In these cases, we must verify that you are an actual person, and in compliance with our Privacy Policy, and will remain so. As a result, we must collect certain personal identification information ("Personal Information"), which includes, but is not limited to, name, email address, contact information, passwords and security data, social media data, and payment information. We may also collect information from other sources, such as various social media platforms, publicly available data, and various third parties to authenticate the identity of the visitor.

DeliveryLo collects personal information to an extent which is necessary to properly provide our services. Visitors to our app may also refuse to provide it, with the potential to lose access or otherwise be prevented from engaging with certain services that we offer. All information provided to us must be true and accurate.

Legal Requirements. We may share your information for a number of legal reasons, including, but not limited to:

·        Complying with any valid legal process, request, applicable law, rule, or regulation.

·        Investigate, correct, or enforce a violation in our Terms of Service or other policy.

 ·        Detect or correct any fraud or security concern on our Site or Apps.

·        Protect the rights, safety, and information of us, or our users.

 

Third Parties: We do not sell your data to third parties for promotional purposes. We may share your information with third parties that work with, and/or for us, to provide our Services. This may include payment processing, data delivery, data hosting, security, analytics, marketing, legal, safety, and/or customer service purposes. Business Transfer. In the case of an acquisition, liquidation, bankruptcy, merger, sale, financing, and/or negotiation, we may share or transfer your information to another entity. You acknowledge that such a transfer could take place at any time, and any acquirer may continue to use your information.

 

Companies on DeliveryLo: We may share your information with the other companies that use DeliveryLo. This includes, among other things, how you interact with messages, channels you subscribe to, and how you consume the content provided on our Services. Some features of our services, such as sending messages on behalf of the company, may require us to share additional information with that company, such as name, email address etc.

Contact Information: We may collect your first and last name, email addresses, phone number(s), and other similar data.

Credentials: We may collect your passwords and other security information used for authentication and access.

Service Usage: We may collect information about how you use our Services. This includes, among other things: account subscriptions, channel subscriptions, access times, IP address, pages viewed, app screens viewed, and pages and/or apps you visited prior to navigating to our app

Push Notifications: We may request to send you push notifications on behalf of ourselves, or our Users. 

Geo Data:We may request to collect location-based information from your mobile device to provide location-based services

You Agree & Confirm

• That in the event any product delivery is delayed or is returned from its destination on your account (e.g., providing the wrong name or address or other incorrect/misleading information), any additional costs incurred by the Company for re-delivery of the product(s) shall be borne by you

• We will not be held responsible for any delay or failure to make delivery of your order if the delay or failure arises from any cause which is beyond our reasonable control

• You agree to use the services provided by the Company for lawful purposes only, and comply with all applicable laws and regulations while using/accessing and transacting on the Marketplace

• You will provide authentic and true information in all instances where any information is requested of you. The Company reserves the right to confirm and validate the information and other details provided by you at any point of time

• If at any time, the information provided by you is found to be false or inaccurate (wholly or partly), the Company shall have the right in its sole discretion to reject registration, cancel all orders, and debar you from using its services and other affiliated services in the future without any prior intimation whatsoever, and without any liability to you

• You are accessing the services made available by the Company and transacting at your sole risk and are using your best and prudent judgement before entering any transaction through the Marketplace

• Before placing an order, you acknowledged to have checked and reviewed the product description carefully and in sufficient detail. By placing an order on the Marketplace, you agree to be bound by the conditions of sale included in the item’s description without exception

Order Limit & Minimum Order Value

• Every store has its own delivery charges. The delivery charges are mentioned on the app and web at the checkout page

• The Company may at its discretion charge you a delivery fee, surge fee, convenience fee, packaging fee etc. for the delivery of Products purchased by you on the Marketplace. Such charges will be notified to you prior to placing an order. By placing the order, you agree to pay for such charges being levied by the Company

• Minimum Order value is 50 rs & first three orders are free delivery for all customers.

Order Cancellation

• As a user, you may cancel an order placed by you before the order enters the “Accepted” stage. For any permitted cancellations, we will initiate a refund, if any, made by you under the relevant order within approximately 48-72 hours.

• Orders may be cancelled by the Company in any of the following cases: (a) if it is suspected that a customer has undertaken a fraudulent transaction, or (b) if it is suspected that a customer has undertaken a transaction which does not conform to or violates these Terms of Use/User Agreement, or (c) in case of unavailability of product(s), or (d) for any reason outside the control of the Company, including causes for delivery-related logistical difficulties. For such cancellations, the Company will initiate a refund, if any, made by you under the relevant order within 72 hours.

• We maintain a list of all fraudulent transactions and non-complying users, and reserve the right to deny access to such users at any time or cancel any orders placed by them in future.

Returns & Refunds

• The Marketplace entitles all users who have purchased a product on the Marketplace to return a product or request replacement after it has been delivered only if there is an issue with the product. If you no longer need the item, bought it by mistake or have changed your mind, you may only return the product at the time of delivery. We will not be able to accept return requests for such cases after delivery.

• If your product has been accepted for return/replacement, please keep the product in the original packaging. In addition, the product must be unused and unwashed, with all tags intact.

• A few products may not be eligible for return and will be marked “Non-returnable” on the product description page.

• We do our best to make sure you do not face the same issue again and improve our services. As a result, we pass on feedback to our merchants who provide the products. 

• The refund timeline depends on the mode of payment used.

• You may request a refund/replacement for Electronics and Cookware products within 7 days of delivery in case there is a quality issue. This request will only be considered if all original tags and packaging are intact. It is also requested that a user should check if the product seal is intact (i.e., not broken) while accepting the order to avoid any kind of damage-related complaints after delivery.

• For payments made through electronic means such as debit card, credit card, net banking, wallet, etc., the refund shall be made using the same payment mode

• All refunds shall be made in Indian Rupees only

UPI

Unified Payments Interface (UPI) is an instant real-time payment system developed by National Payments Corporation of India facilitating inter-bank transactions. The interface is regulated by the Reserve Bank of India and works by instantly transferring funds between two bank accounts on a mobile platform

• UPI is built over Immediate Payment Service (IMPS) for transferring funds

• UPI would appear as a separate tab on the Payment Options page on your android application

• Once you click on the UPI option, it will scan your device to find out the UPI apps on your phone

• You can choose one of the apps to pay for the order and complete the transaction

Refund against the transaction (if any) would be reflected in your respective account within 5-7 working days post initiation
